The state of Washington could take the Department of Energy back to court -- for delays in the construction of Hanford's new waste treatment plant.

In a letter written this week Governor Chris Gregoire and Attorney General Rob McKenna gave Energy Secretary Dr. Stephen Chu a September 26th deadline to respond to their concerns.

They say further delays in the the construction of the vit plant threatens groundwater, the Columbia River and public health.

Secretary Chu will be in Richland next week to discuss issues related to the waste treatment plant.
