KENNEWICK -- Alex Teimouri's backyard is different than it was back in October.
Since that time, his neighbors, William and Cynthia McKay are building a home on the ridge above the Teimouri's home.
And along with that, the McKay's are also building a ten-foot high wall.
"It's a very awful looking wall. I often wonder how the homeowner would feel having that facing his lot," said Teimouri.
Temouri says the McKays built the wall despite homeowner rules that specifically state that retaining walls can't be higher than three feet.
"Because of other non-compliance in the neighborhood, that he (William McKay) feels justified to not comply with CCNR's," said Teimouri.
Teimouri says lawyers representing the Canyon Lakes Homeowner Association say they are negotiating with the McKay's.
In a letter supplied to Teimouri, and given to us by him, attorney P. Craig Walker says it is his recommendation that because of intermittent compliance that the ability to enforce may not prove absolute.
The letter also states that the risk of the board exceeds the benefits gained.
Teimouri also says a complaint filed in court, by the association's lawyers, isn't even valid, because it lacked a cause number.
"The complaint actually wasn't filed but apparently, they are are in negotiations," said Teimouri.
Teimouri says buyer beware when it comes to taking part in Homeowner's Associations.
And he says he will continue to fight until changes are made.
"We would be fine if they lowered to retaining wall to the 36 inches as required by the guidelines," said Teimouri.
Teimouri says he's created a petition with unhappy homeowners about the wall.
He says he's gathered about 19 signatures so far.
We tried contacting the McKay's, and the homeowner association for Canyon Lakes, but they did not return our phone calls.
